Residential Property

Howard Hyman & Co have a strong background in residential conveyancing and can assist you with the purchase, sale or re-mortgage of your property. We specialise in all kinds of residential property in England.

We appreciate that buying or selling your home can be one of the most stressful processes you are likely to encounter and we aim to use our expertise and experience to manage the conveyancing process for you in the quickest and most stress-free way possible.

We set below details of the legal costs on a residential conveyancing transaction, together with the services provided as part of these costs. These costs are exclusive of VAT and disbursements that may be incurred as part of a transaction.

Commercial property transactions are quoted on application.

Sale and Purchase transactions

The above mentioned figures are based on the following assumptions:-

  • The matter proceeds in the usual way and is not expedited.
  • Only one Contract is dispatched on a sale and there is no 'contract race' on a purchase.
  • The transaction does not involve the grant of a new Lease or a Lease extension.
  • The matter does not become overly complicated or there are no extensive delays.
  • We carry out the usual searches on a purchase or re-mortgage.
  • There are no defects in title or with the title documents that require remedying.
  • There is a reasonable level of communication between us.
  • We also act on behalf of your lender if we are on the lender’s panel, assuming there is a mortgage. If we are not on the lender's panel (we act for most High Street banks & building societies) there will be additional costs.
  • On a sale or re-mortgage we are dealing with the redemption on one existing mortgage or charge.
  • If the sale or purchase of a Shared Ownership property or a New Build property this will give rise to additional fees.

The above examples are not an exhaustive list. If your matter becomes unexpectedly complicated, then our costs may be reviewed and you will be advised accordingly in writing.

When your case has been allocated to a Partner/fee earner, you will be provided with a full estimate of the costs and disbursements that are likely to be incurred on your transaction and the hourly charging rate of the Partner/fee earner dealing with your transaction.

Disbursements

In addition to the legal costs for our professional services, you will also incur some third party costs known as “disbursements”. Below is a list of disbursements likely to be incurred in each type of transaction:-

Sales:-

Land Registry searches From £6
Bank transfer fee £49 inclusive of VAT (each transaction)
Management pack (leasehold only) £250 - £500 (estimated)

There will be additional costs on leasehold sales if a Licence to Assign or Deed or Covenant is required by the landlord.

Purchases:-

Stamp duty Calculated on purchase price & buyer’s circumstance
Land Registration fee Calculated on purchase price
Land Registry searches £2 - £7
Bank transfer fee £49 inclusive of VAT (each)
SDLT return fee £80 plus VAT
Search pack £200 - £450 (estimated)
Freeholder registration fee (leasehold only) £50 - £200 (estimated)

In some cases involving a sale or purchase an indemnity policy may be required and we will advise you of the cost of such a policy, if required. If you are drawing down funds from a Help to Buy ISA a further £50 plus VAT will be charged for the additional administrative work involved.

Details of what our costs include and the services provided

Purchase transactions – We will advise you fully and correctly throughout the course of proceedings. We shall provide a full legal report to you on the property prior to exchange of contracts, deal with the submission of your stamp duty return and registration of your ownership at the Land Registry.

Sale transactions – We will advise you fully and correctly throughout the course of the proceedings. We will prepare contract papers and submit these to your buyer’s solicitor, deal with enquiries form the buyer’s solicitor, report to you on the contract prior to exchange , deal with exchange and completion of your matter as well as redemption of your existing mortgage (if applicable).

Re-mortgage transactions – We will advise you fully and correctly throughout the course of proceedings. We shall provide the report on title to the mortgagee or (if separately represented) to their solicitors. If you have an existing mortgage which is to be redeemed, we will obtain the Redemption Statement and will arrange for it to be redeemed simultaneously with the grant of the new mortgage. We will also deal with the registration of your new mortgage at the Land Registry.
